If David Letterman did a countdown of the Top Ten Amendments, the right to religion would come in at the top. Not only is it in the First Amendment, it’s the first right in the First Amendment! And the Court has been busy of late in addressing religious rights in America. The Court has covered legislative prayer, prisoner’s religious rights, corporate religion, and religion in the workplace. We will examine the First Amendment’s religion clauses, the Religious Land Use and Institutionalized Person’s Act, the Religious Freedom Restoration Act and the religious rights under Title VII of the Civil Rights Act.
