Before using the Comedian of Law Website, please read the terms and conditions of use.

By using the Comedian of Law Website, you signify your agreement to these terms and conditions of use. If you do not agree to these terms of use, please do not use the site. We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these terms and conditions at any time. Please check these terms regularly for changes. Your continued use of the Website following the posting of changes to these terms will mean you accept those changes.

All material viewed on this site or during live CLE events are produced, copyrighted, and owned entirely by Joel Oster/Comedian of Law. No duplication of any of these materials in any form without prior written consent by Joel Oster/Comedian of Law is permitted.

Member Account

When you register as a user of this Website, you will be assigned a unique username and password. You are responsible for maintaining the confidentiality of the username and password, and responsible for all activities that occur under your username and password. You agree to notify Comedian of Law of any unauthorized use of your username and password or any other breach of security at info@comedianoflaw.com.

Privacy

Registration data and certain other demographic information about you are subject to Comedian of Law’s privacy policy.

One-Year Subscription

The purchase of a one-year subscription entitles the member to access to all of Comedian of Law’s online classes for twelve months from the date of purchase. This subscription does not guarantee that all classes will be available for the entire year as Comedian of Law reserves the right to change out is courses at their discretion.

Compliance Bundle

The purchase of a compliance bundle entitles the member to all of the Comedian of Law’s online classes for 1 year from the date of purchase. The compliance bundle which will include the maximum number of hours that are permitted for an attorney to take via on-line learning of video-on-demand classes in the state for which the compliance bundle is purchased. For example, it includes 8 hours of classes for Tennessee, including 3 hours of ethics. Compliance Bundles purchased for a particular state will only be submitted to that state for credit. For example, if you purchase a Tennessee online compliance bundle, your hours will only be submitted to Tennessee. If you wish to received credit in more than one state, please purchase the All-Access Subscription. If you wish to submit the course to a state not listed on a website as accredited, you may contact us for information the state CLE commission needs to consider giving you credit. Please note that it is your responsibility to submit the documents to the state CLE Commission and to communicate with them. Comedian of Law will not do this on your behalf.

All-Access Subscription

The purchase of an All-Access Subscription entitles the member to all of the on-line classes for one year from date of purchase and all live classes for 1 year from the date of purchase. This does not guarantee that Comedian of Law will do a live program in the member’s state, only that the member can attend any live class put on by Comedian of Law for one year from the date of purchase. In addition, this does not guarantee that all online courses will be approved in all jurisdictions. Please make sure your state is listed as an approved state for each online course(s) before you actually take the course(s). This subscription does not include CLE events sponsored or hosted by organizations other than Comedian of Law, even if Comedian of Law is a featured speaker at such event.

Courses

All courses purchased in CLE Bundles or individually can be accessed for a 1 year from the date of purchase.

Course Expiration Dates

Due to the varying rules and regulations in each state for accreditation of CLE courses, some courses will expire for different states at different times. To be sure that you are taking courses before their accreditation has expired in your state, first make sure your state is listed as an approved state for that CLE course before you actually take the course.

Comedian of Law has a policy that if one of our users purchased a course that expired before credit was received, we will switch that course for another of equal or lesser value for no charge. Comedian of Law is not responsible for any actions taken against the individual for failure to complete required CLE credits on time because of an expiration issue.

Members Can Only Receive Credit One (1) Time for Each Course

Members can only receive CLE credit one time for each CLE course. Therefore if you take the same course in two separate reporting periods, you will only receive credit the first time you complete the program. However, Comedian of Law does update its courses on a regular basis. After a course has been updated, new accreditation will be obtained for such course. It is the user’s responsibility to ensure that taking the updated course is permissible in the state in which the user is licensed. Some states place restrictions on receiving credit for similar courses in subsequent years.

Fees and Payments

You shall pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred. You shall pay all applicable taxes relating to use of the Website through your account.

Refund Policy

Comedian of Law will provide refunds (minus the non-refundable fee paid to PayPal, which is usually between 2.5-3.0%) if requested within seventy-two (72) hours of the purchase date unless you have viewed a course. Once you have viewed a course, the purchase can no longer be refunded. After the seventy-two (72) hour period, you cannot receive a refund, however, exchanges or substitutions will be provided where necessary. Member will be responsible to pay the non-refundable fees paid to PayPal, which are usually between 2.5-3.0% of the purchase price in the case of any refund.

In states where Comedian of Law pays per credit, the one-year subscription includes reporting fees for the state’s credit requirements per reporting cycle plus carryover credits. Any amount above that will be billed to a member’s credit/debit card. The following states are included: Georgia; Hawaii; Illinois; Nebraska; North Carolina; Pennsylvania; Utah; Tennessee and Washington. Additionally, Comedian of Law will only report credits in one of the above states for courses that are pre-approved for credit in those states.

Restrictions on Use of Course Materials

This includes all materials, including, but not limited to, articles, images, illustrations, designs, icons, photographs, videos and audio files that are part of the Website (collectively, the “Content”). Such content is protected by copyright and owned, controlled or licensed by Comedian of Law, or the party credited as the provider of the Content. You shall abide by all additional copyright notices, information or restrictions contained in any Content accessed through the Website.

No Content from the Website may be copied, reproduced, framed, hyperlinked, republished, downloaded, uploaded, posted, transmitted, or distributed in any way; provided, however, you may download, where specifically permitted, one copy of the Content on any single computer for your personal, non- commercial use only, provided you keep intact all copyright and other proprietary notices. Copying or storing of any Content for other than personal use is expressly prohibited without prior permission from Comedian of Law, or the copyright holder identified in the copyright notice contained in the Content.

If you wish to build a hyperlink to the Website, you may do so provided you agree to cease such link upon request from Comedian of Law. No other use is permitted without prior written permission of Comedian of Law.

Use of any robot, spider, other automatic device, or manual process to monitor or copy our Web pages or the Content is strictly forbidden.

Modification of the Content or use of the Content for any other purpose is a violation of Comedian of Law’s copyright and other proprietary rights. For purposes of these terms, the use of any Content on any other website or networked computer environment is prohibited. All trademarks, service marks and trade names are proprietary to Comedian of Law.

The Content contained on the Website has been prepared by Comedian of Law as a service to its users and is not intended to constitute legal, accounting, tax or financial advice from a professional attorney, accountant, Certified financial planner, or tax preparer. Comedian of Law has used reasonable efforts in collecting, preparing and providing quality information and material, but does not warrant or guarantee the accuracy, completeness, adequacy or currency of the information contained on or linked to the Website. Users of information from the Website or links do so at their own risk.

Non-Transferability

Your right to use this Website is not transferable. Any password or right given to you to obtain information is not transferable.

Indemnification

You agree to indemnify, defend and hold Comedian of Law harmless from any liability, loss, claim and expense, including reasonable attorneys’ fees, related to your violation or alleged violation of this Agreement or use of the Website.

Those who choose to access the Website from other locations do so on their own initiative and are responsible for establishing the useability or correctness of any information or Content under any or all jurisdictions and the compliance of that information or Content with local laws, if and to the extent local laws are applicable.

All users, including those users who access the Website from a country other than the U.S., agree that the laws of the State of Kansas shall govern any dispute, including those arising from Comedian of Law’s use of personal information or otherwise relating to privacy, as specified in the Privacy Policy.

These terms shall be governed by and construed in accordance with the laws of the State of Kansas. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the state or federal courts located in Kansas and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. You agree that regardless of any law or statute to the contrary, any claim or cause of action arising out of or relating to the Website and these Terms of Service must be filed within one (1) year of the date the cause of action arose, or be barred as untimely. This is the entire agreement between us relating to the subject matter herein and shall not be modified except as provided herein or in writing, signed by Comedian of Law.

To the extent that anything in or associated with the Website is in conflict or inconsistent with this Agreement, this Agreement shall take precedent. Comedian of Law’s failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision.
Termination

These terms are effective until terminated by either party. You may terminate these terms at any time by destroying all Content obtained from any and all Website(s) and all related documentation and all copies and installations thereof, whether made under these terms or otherwise. The privileges granted to you by these terms, including the maintenance of a member account, will terminate immediately without notice from Comedian of Law if, in Comedian of Law ‘s sole discretion, you fail to comply with any provision of these terms. Upon termination, you must destroy all Content obtained from the Website and all copies thereof, whether made under these terms or otherwise. Comedian of Law may take such further action as Comedian of Law determines to be appropriate under the circumstances to eliminate or preclude repeat violations, and COMEDIAN OF LAW shall not be liable for any damages of any nature suffered by any customer, user, or any third party resulting in whole or in part from Comedian of Law’s exercise of its rights under these terms and conditions.

Comedian of Law respects the confidentiality of visitors to its site. Data relating to individuals visiting Comedian of Law will not be used in violation of the visitor’s privacy.

Comedian of Law collects the e-mail addresses of those who communicate with us via e-mail, aggregate information on what pages consumers’ access or visit, and information volunteered by the consumer (such as survey information and/or site registrations). The information we collect is used to improve the content of our Web pages and the quality of our service, and is not shared with or sold to other organizations for commercial purposes, except to provide products or services you’ve requested, when we have your permission, or under the following circumstances:

Information Gathering and Usage

When you register as a member for Comedian of Law, we ask for for your full name, email address, postal address, username, and password.

Comedian of Law uses collected information for the following general purposes: products and services provision, identification and authentication, services improvement, contact, and research.

• A cookie is a small amount of data, which often includes an anonymous unique identifier, that is sent to your browser from a web site’s computers and stored on your computer’s hard drive.
• Cookies are required to use the Comedian of Law service.
• We use cookies to record current session information, but do not use permanent cookies. You are required to log-in to your Comedian of Law website after a certain period of time has elapsed to protect you against others accidentally accessing your account contents.

Disclosure

Comedian of Law may disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of Service.
